"On Judicial System in Ukraine"

The draft determines that judicial power in Ukraine will include:

• local courts (general, specialized, military, commercial);
• courts of appeal (general, specialized, military, commercial);
• highest specialized courts (the Highest Civil Court of Ukraine, the Highest Commercial Court of Ukraine, the Highest Administrative Court of Ukraine, the Highest Criminal Court of Ukraine);
• the Supreme Court of Ukraine.

As compared to the current judicial system, the Cassation Court of Ukraine will be eliminated. The Cassation Court of Ukraine was created according to the current Law of Ukraine "On Judicial System".

The following shall take part in court consideration of cases:

• people's assessors (in local general, specialized and military courts);
• jurors (in local general, specialized and military courts, when considering criminal cases).

Consideration of cases in courts with participation of jurors and people's assessors is suggested to be launched from January 1, 2010.

The draft suggests recognizing as invalid the Laws of Ukraine "On Judicial System in Ukraine" and "On Status of Judges".
