"On Fundamentals of Regulatory Policy in the Sphere of Entrepreneurial Activity"

This draft determines legal fundamentals for implementation of state policy in the field of entrepreneurial activity. This draft is directed at ensuring constitutional rights of citizens to carry out entrepreneurial activity.

It is proposed to create special authorized central body of executive power on issues of regulatory policy and entrepreneurship (hereinafter – special authorized central body) to fulfill provisions of this draft. Its authorities will be approved by the Decree of the President of Ukraine.

It should be noted that there is established a list of compulsory administrative procedures needed to prepare and implement a regulatory act to regulate entrepreneurship relationships. These procedures include:

1. planning of regulatory activities (for bodies of executive power);

2. preparation of draft regulatory acts justifications:

3. development of draft regulatory acts;

4. public discussion of draft regulatory acts;

5. agreeing draft regulatory acts with special authorized central body of executive power (for bodies of executive power);

6. approval, state registration and publication of regulatory acts.

In accordance with this draft Law there shall be agreed on compulsory basis:

- draft regulatory acts, worked out by the central bodies of executive power – with special authorized central body;

- draft regulatory acts of the Council of Ministers of the Autonomous Republic of Crimea, territorial bodies of central bodies of executive power – with corresponding territorial bodies of the special authorized central body.

Adoption of the draft will allow to fix in legislation authorities that now are vested in the State Committee of Ukraine on issues of regulatory policy and entrepreneurship. Now this Committee acts on the basis of Regulation on State Committee of Ukraine on issues of regulatory policy and entrepreneurship that was approved by the Decree of the President of Ukraine, reg. N 721/2000 of May 25, 2000.
