"On Foreign Workers in Ukraine"

According to this draft foreign workers are those individuals who are not citizens of Ukraine and are temporarily staying on its territory on a legal basis in order to carry out their labor activity on the terms of employment.

Engagement and use of foreign workforce in Ukraine may take place if there are available free workplaces, provided that Ukrainian citizens possessing needed professional skills and qualifications necessary to meet job requirements do not apply for these jobs.

The Ukrainian employers, willing to hire foreign workers, must get a relevant permit that is issued by the migration authorities.

This draft envisages introduction of quota for engaging and using foreign workforce in Ukraine. Such quota shall be established by the Cabinet of Ministers of Ukraine.

Foreign workers may carry out labor activity in Ukraine if they receive the relevant authorization confirming their right thereto.

This draft law also outlines obligations of foreign employees as well as obligations of employers using foreign workforce.
