“On Measures to Regulate Prices of Medicines and Medical products”

According to this draft prices for medicines and medical products sold in Ukraine shall be subject to state regulation through setting up ceiling amounts which can be added (extra charges), in percents, to the wholesale price of manufacture of medicines and medical products or to customs value of those imported into the customs territory of Ukraine.

Amount of extra charges on medicines and medical products, within the limits of ceiling amount, shall be established by the decision of the Council of Ministers of the Autonomous Republic of Crimea, oblast, Kyiv and Sevastopol city state administrations in accordance with the procedure set forth by the Cabinet of Ministers of Ukraine.

Ceiling amounts of extra charges on medicines and medical products, including VAT, must not exceed, when are being sold to

- population through the pharmacies’ network – 55 percents;

- health institutions financed from the state and local budgets – 15 percents.

The Cabinet of Ministers of Ukraine specifies the list of medicines and medical products whose prices are not subject to state regulation.

It should be noted that, in general, adoption of the draft law in question is to enhance accessibility to population of medicines and medical products. Moreover, authorities of local bodies of executive power on price regulation are fixed on the legislative level. Unfortunately, the authors of the draft law have not provided needed assessments of the ceiling amounts of extra charges on medicines and medical products, which have been proposed by them in the draft.

This, in its turn, makes impossible determination of the impact on financial and economic situation of the business entities on the market of medicines and medical products.
