“On Amendment of Some Legislative Acts of Ukraine Related to Regulation of TV and Radio Advertising”

This draft envisages amendment of the Laws “On Advertising”, “On TV and Radio Broadcasting” and “On the National Council of Ukraine on TV and Radio Broadcasting”.

Separate requirements related to sponsorship will be established by amendments proposed to Article 5 of the Law “On Advertising”.

According to the suggested amendments to Article 12 there will authorized interruptions of movies once every 45 minutes (now it is prohibited to interrupt movies by advertising). This will allow placing advertisements during the time when TV is watched by the biggest audience.

The amendments to Article 12 provide for that ceiling volume of advertising compared to general volume of broadcasting shall be assessed on daily basis, but not hourly. This will allow to TV and radio broadcasting organizations to increase the volume of advertising during the hours when there is the biggest audience and, by doing so, compensate reduction of advertising when the audience is not so large in number.

It is suggested to delete from the Laws “On TV and Radio Broadcasting” and “On the National Council of Ukraine on TV and Radio Broadcasting” the norm stipulating that the National Council of Ukraine on TV and Radio Broadcasting may establish minimum prices on advertising on national broadcasting channels. This amendment will give more freedom to TV-and radio broadcasting companies, which employ the national broadcasting channels, as to making own decisions on economic matters.

Amendments to the Law “On TV and Radio Broadcasting” are to set up in Ukraine a new order for broadcasting (re-broadcasting) of advertisements which have not been paid to the Ukrainian TV-radio broadcasting organization.
