"On Anti-Monopoly Committee of Ukraine"

This draft provides for adding a new Article 8-1 “Verification of Adherence to the Anti-Monopoly Legislation” to the Law of Ukraine “On Anti-Monopoly Committee” and introducing relevant amendments into a series of other articles of this law.

According to the new article the procedure for verifying relevant subjects by the Anti-Monopoly Committee of Ukraine shall be fixed in legislation.

There are established subjects to be verified by the Anti-Monopoly Committee of Ukraine. These are enterprises, institution, organizations irrespectively of their organizational legal forms and property forms.

There will be determined conditions for holding verifications, i.e., the procedure of issuance of the needed documents by the Anti-Monopoly Committee to carry out verifications, reasons to deny conduct of verification.

This draft governs the activities of the control body and the subject of verification, regulates the issues related to non-disclosure of information that became known to the Anti-Monopoly Committee during conduction of verifications.

This draft law, if adopted, will facilitate improvement of current legislation in the part related to state control over adherence to anti-monopoly legislation, prevention, disclosure and termination of violations of anti-monopoly legislation, will better protection of rights and legitimate interests of enterprises, institutions and organizations.
