“On Packaging and Packaging Wastes”

This draft outlines legal relationships in the area of production and usage of packaging and packaging wastes, and is aimed at minimizing risks for human health and environment.

According to this draft, packaging is the product resulting from processing of any materials for the purpose of: placing; storage; protection; usage; transportation; presentation; sale of products on their way from a producer to a consumer or a final user.

Depending on the destination, packaging may be divided into the following types:

• trade;
• group;
• transportation.

This draft establishes special system to recycle packaging wastes.

According to this draft packaging wastes may be recycled by a number of enterprises, institutions, organizations and consumers, who shall perform their activities in compliance with a unified program.

Packaging usage includes:

• production, placing packaging materials on the market;
• production, placing packaging on the market;
• use of packaging for the purpose of wrapping products;
• placing packaged products on the market;
• use of reusable packaging.

This draft sets forth the rights and duties in the area of usage of packaging and wastes thereof.

Chapter IV of the draft defines competence of executive power bodies and bodies of local self-government in the field of usage of packaging and packaging wastes.

The draft establishes utilization norms for packaging wastes and admissible concentration of chemicals in packaging.

It is also envisaged to establish responsibility for violations in the sphere of packaging and packaging wastes usage.
