“On Amendment of Some Laws of Ukraine”

This draft provides for amendment of the Laws of Ukraine “On Pesticides and Agrochemicals”, “On Land Reclamation”, “On the Licensing of Certain Types of Economic Activity”, “On Peculiarities of State Regulation of the Activity of Business Entities Engaged in Production, Export, Import of Laser-Readable Discs”, with regard to the licensing of certain types of economic activity.

According to the draft, only production, wholesale and retail trade in pesticides and agrochemicals regulating plant growth will be subject to licensing. The body authorized by the Cabinet of Ministers of Ukraine will issue licenses for the mentioned types of activity.

The proposed amendments will substantially weaken state control over entrepreneurial activity and expand the list of activities that will be performed in this area without the need to get the relevant license. This will take place due to the fact that plant growth regulators are a part of a number of agrochemicals whose production, wholesale and retail trade will not require issuance of the relevant permit.

According to the proposed amendments, the specially authorized central body of executive power on issues of water industry and land reclamation shall have no right to issue licenses for planning, construction and reconstruction of objects of engineering infrastructure needed for performance of land reclamation activity.

Activity associated with export, import of equipment and discs for laser-readable systems will be excluded from the list of licensed types of economic activity.
