“On Land Evaluation”

The draft outlines legal foundations for land evaluation in Ukraine and performance of the relevant professional activity in this field.

According to this draft law, subjects of evaluation activity in the field of land evaluation may be:

  • specially authorized bodies of executive power on land resources;
  • other bodies of executive power and local self-government that employ land evaluators;
  • legal entities, irrespectively of their ownership, which have in their staff one or more evaluators, provided they [legal entities] have the license for execution of land evaluation works;
  • natural persons, being subjects of entrepreneurial activity, who have qualification certificates of land plots evaluators and relevant licenses for performance of land evaluation works. It should be mentioned that foreigners and stateless persons are allowed to perform land plots evaluation activity.

This draft law outlines the following two types of land evaluation: economic, monetary (normative and expert).

Economic and monetary land evaluations are to be carried out in line with the methodologies approved by the Cabinet of Ministers of Ukraine. This draft specifies a number of cases where monetary land evaluation is compulsory.

Technical documentation is to be drawn up on the basis of the conducted economic and monetary normative land evaluation. Results of the conducted monetary expert evaluation of land plots shall be reflected in a report.

Works associated with land evaluation are to be financed from the State Budget of Ukraine, local budgets, funds of landowners and land users, and other sources that are not prohibited by legislation.

Development and introduction of this draft law into the Verkhovna Rada of Ukraine has been stipulated in Final Provisions of the Land Code of Ukraine.
