"On Amendment of Some Laws of Ukraine for Canceling Double Certification of Food Products"

The draft suggests amendments to the Laws of Ukraine "On State Regulation of Import of Agricultural Products", "On Quality and Safety of Food Products and Food Raw Materials" and the Decree of the Cabinet of Ministers of Ukraine "On Standardization and Certification".

The draft suggests permitting customs clearance of imported food raw materials and accompanying materials on the basis of a declaration on conformity issued by the producer, at the same time provided the following requirements are met:

• the producer and the buyer of the goods are certified according to requirements of the international standard ISO 9001;
• the buyer submits to the body performing customs clearance a written guarantee on use of the imported food raw materials and accompanying materials exclusively for production of food by such buyer.

Also the draft suggests permitting import of goods from groups 1-24 of the Ukrainian Classification of Commodities for Foreign Economic Activity, which are imported as samples for research or testing, without submission of certificates on conformity, certificates on recognition or declarations on conformity to customs bodies.

The draft also cancels the norm of Article 18 of the Decree of the Cabinet of Ministers of Ukraine "On Standardization and Certification", according to which customs bodies should perform customs clearance of imported goods on the basis of the Unified Register of Products Certified in Ukraine pursuant to the procedure set forth by the Cabinet of Ministers of Ukraine. The present norm is to be canceled because it introduces additional conditions for customs clearance of goods.

Approval of these amendments will help in eliminating double interpretation of norms of laws related to certification of goods and will contribute to adjusting provisions of all normative and legal acts related to certification and each of them to the rest.
