"On Amendment of Article 328 of the Customs Code of Ukraine"

The draft envisages limiting the term for possible application of confiscation of goods as a type of penalty for violation of customs rules. According to the draft, this term shall not exceed 12 months from the date of committing violation.

Currently, Article 328 of the Customs Code of Ukraine (which comes into effect on January 1, 2004) envisages confiscation of objects, which are transferred over the border with violation of customs rules or goods or motor vehicles, in which they were transported, regardless of the time of committing or revealing violation.

The draft, if approved, will permit setting forth clear periods of limitation for applying confiscation of goods for violation of customs rules.
