Draft Law of Ukraine

"On Amendment and Addition of Some Legislative Acts"

The draft suggests amendments to the following Laws of Ukraine:

• "On Entrepreneurship";
• "On Foreign Economic Activity";
• "On Licensing Some Types of Economic Activity";
• "On Employment of Population".

The draft envisages limiting activity of subjects of entrepreneurial activity – natural persons – on rendering intermediary services on abroad employment of Ukrainian citizens with a foreign employer.

The draft suggests including entrepreneurial activity on rendering intermediary services to foreign employers on selecting the necessary personnel – Ukrainian citizens – for abroad employment to types of foreign economic activity, which are not prohibited.

Activity of business entities related to rendering intermediary services on employing Ukrainian citizens abroad with a foreign employer shall be performed only on the basis of a respective license (hereinafter referred to as "the License"). The License is issued by a specially authorized central body of executive power in the field of labor and social policy.

The License shall ensure the right to perform economic activity exclusively within a foreign economic agreement on rendering intermediary services to foreign employers on selecting the necessary personnel – Ukrainian citizens.

According to the draft, in case the licensee or their representative does not arrive for consideration of the issue on annulling the License for a certain type of economic activity without a serious reason, the decision may be passed in their absence.
