"On Amendment and Addition of the Criminal Code of Ukraine (Related to Release or Sale of Low-Quality Goods)"

The draft suggests adding Article 227 of the Criminal Code of Ukraine with part two. This part envisages enforcing the level of responsibility of a guilty person for release to the commodity market or other sale to consumer of low-quality goods, which may be dangerous for life and health of people.

The suggestion on enforcing responsibility of a guilty person for release or sale of goods, which may negatively influence life and health of people, is positive. Enforcement of responsibility will contribute to better protection for consumer's rights, so they will obtain safer products.

Apart from the positive point, the amendments include provisions, which contradict to the objective of the draft law. The draft envisages that a guilty person shall be punished with imprisonment for a certain period for release or sale of goods, which may have a negative impact on health of people. As an additional responsibility confiscation of these goods and products as well as equipment and materials, designated for manufacture thereof, may be applied. Thus, the draft envisages a possibility that products, which may have a negative influence on health of people, might remain in the trade network and might be used in the future.
